The Pentagon is exploring voluntary agreements under the Defense Production Act as a way for defense contractors to share sensitive supply chain information without running afoul of antitrust laws. Michael Cadenazzi, the assistant secretary of Defense for Industrial Base Policy, outlined the approach, saying, “Our interest is using voluntary agreements … For us to articulate problems to them around nasty issues in the supply chain and the industrial base that allow them to communicate and work together, essentially collude.”

The move reflects growing concern within the Department of Defense about fragility in the defense industrial base, particularly around critical components and materials. By invoking the Cold War-era statute, the Pentagon aims to create a legal safe harbor for companies that might otherwise be prohibited from pooling intelligence on shortages, bottlenecks, or single points of failure.

Such arrangements would mark a significant shift in how the Pentagon manages its supply chain relationships. Traditionally, the department has relied on market forces and bilateral contracts, but officials now argue that the scale of the challenge — from microelectronics to specialty metals — demands a coordinated industry-wide response. The legal framework would allow firms to collectively identify vulnerabilities without triggering collusion penalties.

The initiative has not yet been formally proposed, and it remains unclear whether the Justice Department or Federal Trade Commission would support waiving antitrust enforcement for defense contractors. Critics warn that the arrangement could inadvertently entrench incumbent suppliers or raise prices if oversight is weak, though Cadenazzi emphasized the goal is limited to addressing “nasty issues.”

No legislative changes are required; the Defense Production Act already grants the president broad authority to incentivize domestic industrial capacity. The Pentagon has not disclosed which specific sectors would be targeted first, nor has it set a timeline for implementing the voluntary agreements.
