Clear Cooperation—a policy requiring brokers to submit listings to the MLS within one business day of marketing them—gains fresh clarification through a new guide on one-to-one broker communication exceptions. This follows ongoing industry debate over the rule's scope and enforcement.

The release comes amid broader regulatory scrutiny of NAR's practices, including ongoing Department of Justice investigations and settlement-related rule changes. The association positions these resources as tools to help members stay compliant while maintaining competitive market access.

Critics argue that the guidance may not fully address member confusion over Clear Cooperation's exceptions, particularly regarding off-MLS and pocket listing strategies used by some brokerages. NAR maintains the resources reflect the current policy framework as adopted by its board.
